Nueva ley antifraude

La Ley Antifraude tiene como principal objetivo combatir el fraude fiscal en el tejido empresarial español. La nueva Ley Antifraude es una regulación que afecta principalmente a los procesos de gestión internos y a los programas informáticos de facturación y contabilidad.

La ley abarca una amplia gama de aspectos relacionados con el fraude fiscal, desde las criptomonedas hasta los pagos en efectivo, así como las sucesiones. Con esta legislación, el Gobierno busca garantizar una mayor integridad en las transacciones, la conservación de la factura, mejorar la accesibilidad y posibilitar la trazabilidad en caso de ser requerida.

Una de las principales implicaciones de la Ley Antifraude es la obligación para las empresas de contar con un software de facturación verificable para remitir las facturas a la Agencia Tributaria. Este software debe permitir el registro de facturación, el envío de registros a la Agencia Tributaria, el registro de eventos y la identificación de cada registro con un QR.

Para cumplir con estos requisitos, es fundamental contar con programas de facturación para pymes y programas de contabilidad para autónomos que estén debidamente certificados y cumplan con los estándares establecidos por la ley. La implantación de un sistema de emisión de facturas verificables o sistema VeriFactu, garantiza la adecuación a la normativa y ayuda a evitar posibles sanciones y multas económicas.

En caso de incumplimiento, las empresas se enfrentan a sanciones que pueden alcanzar hasta los 150.000 € para los fabricantes de software y los 50.000 € para aquellas que presenten anomalías en cada ejercicio fiscal. Es importante tener en cuenta que, en caso de conductas sancionables en varios ejercicios fiscales, las multas se aplicarán por cada uno de ellos, lo que puede tener un impacto significativo en la contabilidad final.

Actualmente, el Ministerio de Hacienda está trabajando en el proceso de control del software de contabilidad y en la certificación oficial que demostrará su cumplimiento con los requisitos establecidos. Es fundamental que las empresas y autónomos estén al tanto de estos cambios legislativos y se aseguren de contar con las herramientas adecuadas para cumplir con la nueva normativa y evitar posibles sanciones. La adaptación temprana a estas regulaciones garantizará una gestión financiera más transparente y segura para todos los contribuyentes.
